CErion Member	posted 04-12-2013 02:24 PM Hello all; First time, long time. There are 3 employees suspected of stealing property from their empolyer. The responding officer suggested that their continuted employment was contingent on completing polygraph testing for the police investigation, prior to consulting me about the case. Should I run this test, any EPPA issues on my end as a LE Examiner? Thanks in advance. Chris IP: Logged
Barry C Member	posted 04-12-2013 06:26 PM As long as you're not acting as an agent of the employer (and you're not), then you, as law enforcement, are exempt from EPPA. You should still set the record straight in order to get informed consent to test should any of them volunteer to submit to testing. In other words, tell him or her you don't work for the employer and this test is for LE and should have no impact on his or her employment whether he or she takes the test or not. (After all, you are looking for willing volunteers - not a mandated volunteer, and you may have that until you explain the situation and get informed consent.) IP: Logged
